1. Acceptance of Terms

By using services from EstateDetect.com (“we,” “us,” or “our”), you (“Customer,” “you”) agree to these legally binding Terms and Conditions. If you disagree, do not use our services.

2. Service Description

We provide property risk assessment reports (“Reports”) to identify potential problems (e.g., zoning, environmental, or regulatory risks) in a specified area.

  • No Guarantee: While we strive for accuracy, Reports are informational only and not exhaustive. We do not guarantee 100% completeness, correctness, or detection of all risks.
  • Customer Responsibility: You are solely responsible for final decisions based on our Report. Our service does not replace professional legal inspector advice.

3. Refund & Cancellation Policy

  • 24-Hour Window: You may cancel an order or request a full refund within 24 hours of payment.
  • After 24 Hours: No cancellations, refunds, or modifications are permitted.
  • Processing Refunds: Approved refunds (within 24 hours) will be issued to your original payment method within 14 business days.

4. Consent Letter Requirement

If you provide a valid written consent/authorization letter from the current property owner:

  • We will try to include data from relevant government bodies in your Report.
  • No Guarantee of Accuracy: Government data is incorporated “as is.” We do not warrant its 100% correctness or completeness.

5. Limitation of Liability

  • Cap on Damages: In no event (including negligence or lawsuits) shall our total liability exceed 70% of the fee paid by you for the Report.
  • Excluded Damages: We are not liable for indirect, consequential, or punitive damages (e.g., lost profits, property value loss, or third-party claims).
  • Indemnification: You agree to indemnify us against claims arising from your use of the Report.

6. Jurisdiction & Dispute Resolution

  • Governing Law: These Terms are governed by the laws of British Columbia (BC), Canada.
  • Exclusive Venue: Any lawsuit or dispute must be filed exclusively in Vancouver, BC, Canada. You submit to this jurisdiction.

7. Order Process

  • Orders are final upon payment.
  • Delivery timelines are estimates and not guaranteed.

8. General Provisions

  • Amendments: We may update these Terms; continued use constitutes acceptance.
  • Severability: If any clause is unenforceable, the remainder remains valid.
  • Waiver: Failure to enforce a right does not waive that right.
